Experience

Our experience includes advising:

US screening laboratory. Defending over 100 CervicalCheck claims by women alleging smear tests were negligently screened, resulting in delayed diagnoses of cancer. Advised on appeal to Court of Appeal in 2022 from the High Court as to obligation to exchange expert reports. Appeal described as of systemic importance to personal injury claims in Ireland including clinical negligence claims.
Medical device company. Advice regarding the withdrawal of a medical device which has been implanted in patients in Ireland to include the defence of a cohort of high court proceedings.
DePuy Hip Product liability claims: Acting for over 20 consultant orthopaedic surgeons in over 400 product liability claims. Court approved ADR structure is in place.
Scottish NHS laboratory: Advising on defence of High Court claim following termination of a pregnancy. First case to deal with Health (Regulation of Termination of Pregnancy) Act 2018 which gave effect to the 36th amendment to Irish Constitution, allowing for termination of pregnancy in defined instances.
Medical indemnifier. Representing medical doctors before Medical Council inquiries.
Veterinary indemnifier. Defending professional negligence claims.
Pharmaceutical company. Advising on defence on high court proceedings arising out of alleged chemical exposure at work causing severe personal injuries.
Telemedicine company. Advice re telemedicine and prescribing regulations in Ireland.
Medical Device company. Due diligence advice re potential acquisition of medical device company to include compliance with Irish and European Regulations.
Veterinary practice. Due diligence advice re potential acquisition of group of veterinary practices.
